CUSTOMER, by accepting continued service or by making payment, AGREES TO THE FOLLOWING:
Customer’s payment constitutes acceptance of all terms hereof.
In the event of a default in payment by the customer, Bavarian shall recover all costs and reasonable attorney fees incurred or expended to collect the amount due.
Customer consents to jurisdiction of Court in Boone County , Kentucky , for disputes or legal action arising from agreement.
Customer agrees to pay any applicable taxes, surcharges or fees imposed by law.
No illegal or hazardous waste is permitted.
No liquids (household paint must be solidified).
All waste must be drained, bagged and placed in fly-tight cans at the curb the night before collection day unless otherwise agreed in writing.
Drums or barrels are not acceptable as containers and will be removed as trash and not returned, and as such Bavarian assumes no liability for replacement.
Cans or items placed at curb for collection must not weigh more that 75 lbs, as per County ordinance.
Shrubbery or loose material must be tied in bundles that are less than 4 feet in length.
Not responsible for damage to cans.
Materials that pose risks of ignition. (e.g., hot ashes, ammunition, etc.) will not be accepted.
Customer will hold Bavarian harmless for damages beyond the curb line resulting from service requiring entry of equipment or personnel onto customer's premises.
Payment is due 15 days from invoice date unless stipulated otherwise in writing.
Late payment or dishonored checks will result in additional charges to customer's account.
Customer responsible for additional charges for large, bulky or bundled items, and for volumes that exceed 6-30 gallon cans.
Collection service provided on all Holidays except Christmas and New Years day.
